Curricula

ON THE JOB TRAINING

Induction courses for magistrates, court presidents, court clerks and other support staff mostly on substantive procedural subjects, judicial and prosecutorial skills (our court clerks act as prosecutors in the Local and Central Courts) and administrative matters as most judicial officers' functions also entail being administrators of their courts.

Local, regional, continental and international courses, workshops, seminars and conferences on a number of topical legal issues.

  • Few court presidents have attended the Family Law and Family Court Processes wherein indigenous and religious laws were addressed

  • Most magistrates have attended numerous courses, workshops, seminars and conferences which covered a number of topical issues and amongst them they covered the following areas:

  • Family Law and Family Court Processes, Judicial System Training in Drug-Related Casework, Crime Prevention and Criminal Justice, Enforcement and Implementation Aspects of Anti – Money Laundering Legislation, International Co-operation in the Combating of Terrorism and its Financing, Commonwealth Workshop for Human Rights Defenders for the African Region, The Pan-African Forum on the Commonwealth (Latimer House) Principles on the Accountability of and the Relationship between the Three Branches of Government, to mention but a few.

As it has been identified that one of the reasons for delays in the administration of justice is poor supervision and performance accountability a number of local meetings and workshops were held on performance assessment, accountability systems and community service as a way of improving the methods of performance assessment and accountability systems in the subordinate courts and, where practicable, to also assist other sectors in the justice sector in their performance.

FORMAL TRAINING AND DEVELOPMENT

LONG-TERM TRAINING:

We have long-term training which is intended for the acquisition of academic and professional qualifications for effectiveness in job performance and it is funded by the individual judicial officer through loan bursaries or otherwise. As this training is longer than six (6) months the judicial officer has to be on study leave with full pay for the first six(6) months and thereafter on half-pay until completion of studies.

As the officer will draw a salary during the period of training, the training she/he undertakes should not be his/her exclusive choice but it should also be the preferred choice of his/her manager as it should be training that will benefit the judiciary and not just the officer.

  • Currently one (1) Judicial Commissioner is on a two-year study leave pursuing a Master of Laws (LLM) in Child Justice

  • Two (2) Local Court Presidents are on five (5) year study leave pursuing Bachelor of Laws (LLB), they are left with two (2) and three (3) years respectively

PART-TIME TRAINING:

Academic qualifications can also be acquired through part-time and/or distance education and in this instance the officer remains on the job but there may be periodic releases which in terms of the Lesotho Public Service Training and Development (which currently applies even for the judiciary) should cumulatively be a maximum period of eight (8) weeks for every year of study. As we are once again referring to acquisition of academic skills this kind of training is funded by the individual officer

The Local Law Certificate Programme

  • This programme is run by the ministry of justice through the office of the Magistrate (Judicial) Training Officer

  • It is both a part-time and distant education programme as those who fail to attend part-time classes still receive their study materials, assignments and feed-backs through hand or post deliveries

  • In this programme we use part-time lectures who are mostly magistrates, legal practitioners and people with particular  theoretical and practicalexpertise in certain subjects

  • The methodology used is attendance of three (3) one (1) week study schools,  submission of two (2) assignments, and the sitting for one (1) trial examination and first-part final examination for the first six (6) months and the same procedure is again adopted during the next six(6) months of the year with the second part examinations being written at the end of the year. The work-load will depend on the number of subjects for which one is registered.

  • As this is a part-time, distance and open programme for people who are mostly in full-time employment there is a flexibility that one can complete it in three(3) years. Currently a total of nine (9) subjects are offered and the syllabus is attached for ease of reference

  • This programme is intended for all members of law-enforcement agencies who do not have basic knowledge of the law but priority is given to Central and Local Court Presidents and Court Clerks in the Local, Central, Judicial Commissioner's and Magistrates' Courts. The next priority is given to other law enforcement officers and finally we reserve a certain quota for fresh school leavers as one of the job-specifications of the position of Court Clerk is that they should be in possession of a Local Law Certificate and for this reason we have to give allowance for the training of aspiring court clerks

  • The objective of the programme is to give serving officers and aspiring officers basic training in law for effective job-performance

BUDGET: 

The total budget for the subordinate courts for fiscal year 2006/2007 is M30, 935, 800.00
